DMCA Policy

1. Overview
KloudsavvyLMS respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the KloudsavvyLMS platform.
If you are a copyright owner, or authorized to act on behalf of one, and believe that your copyrighted work has been copied in a way that constitutes copyright infringement on our platform, please submit your claim via the procedure outlined below.
2. DMCA Takedown Notice
To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the infringing material: A description of where the material that you claim is infringing is located on the KloudsavvyLMS platform, with enough detail that we may find it on the platform (e.g., course name, lesson title, URL).
- Your contact information: Your name, address, telephone number, and email address.
- Good faith statement: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Your signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

4. Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent with the following information:
- Your physical or electronic signature
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal court in your judicial district and that you will accept service of process from the person who provided the original DMCA notification
If we receive a valid counter-notification, we will forward it to the party who filed the original DMCA notification. If the original notifier does not file a court action within 10 business days, we may restore the removed content.
5. Repeat Infringers
In accordance with the DMCA, KloudsavvyLMS will terminate, in appropriate circumstances, user accounts that are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Misrepresentation Warning
⚠️ Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by a service provider who is injured by such misrepresentation.
